  • $350,000 settlement after lawsuit was filed. Our client suffered multiple serious injuries including bilateral hand injuries with multiple metacarpal fractures which required surgical intervention. Medical expenses exceeded $80,000. The motor vehicle crash was caused by a commercial tractor trailer towing a tandem trailer that stopped the trailer partially in the travel lane of a state highway and failed to place lighted fuses behind the trailer, alerting motorists to the trailer. The tortfeasor’s insurer initially offered $25,000 in settlement of our client’s personal injury claim, which was rejected. Civil suit was filed in the Superior Court and discovery was in progress, including the deposition of the commercial tractor trailer driver. Ultimately, the insurer offered to attend mediation. The tortfeasor’s original offer of settlement was increased by $325,000 at Mediation.
  • $337,000 arbitration award by a three member panel involving serious injuries including a closed head injury, neck spasm, and related trauma when our client was rear-ended.  Medical expenses totaled $5,800.00.  The tortfeasor’s insurer offered its policy of $20,000.00, which our client accepted after obtaining permission from his insurer.  His insurer offered $5,000.00 of his underinsured motorist policy limits.  When our client rejected his insurer’s offer of settlement, the parties proceeded to arbitration.  Our client underwent a neuropsychological examination and evaluation over a two-day period where it was determined he suffered post-concussion disorder after striking his head on the steering wheel.

The bodily injury insurer initially offered $2,500, citing as reasons therefore that the crash impact was minimal and that the victim’s prior medical records indicated pre-existing shoulder pain. The matter was arbitrated and our client was awarded $121,241.00, $118,741 more than the initial offer of settlement and we successfully rebutted the Defense’s highly paid medical expert.
